A 79-YEAR-old drink driver told magistrates he could not remember why he had got into a car after drinking whisky.

Michael Mabey was banned from getting behind the wheel during his court appearance at Worcester Magistrates Court. 

Mark Hambling, prosecuting, said on May 20 this year police were called to a crash involving the defendant's Seat Ateca in Cedar Avenue, Malvern, not far from Mabey's home address.

The prosecutor said Mabey was found at home and he was asked to take a roadside breathalyser test, which he failed. 

After being taken to the police station the evidential sample Mabey gave police was 66mcg of 100ml of breath - the legal limit being 35mcg. 

The prosecutor added the defendant had no previous convictions losing his good character by admitting an offence of driving a motor vehicle when the alcohol level was above limit.

Mabey, who defended himself, was asked by the court clerk if there was anything he wanted to say about the offence. 

"I can't believe I have done something like that," Mabey said. 

"I can't make a plea for anything.

"It won't happen again."

Mabey said he couldn't remember getting in the car after drinking while cooking, and admitted he hadn't kept an eye on how much he had been drinkin

Philip Newton, chairman of the magistrates, told Mabey he was being disqualified from driving for 18 months. 

Mabey was fined £120 and ordered to pay costs of £135 and victim surcharge of £48.

The chairman explained to Mabey they were giving him the chance to do the drink-drive awareness course. 

Mabey was told, if he successfully completed it, that would reduce his ban length by 18 weeks. 

Mabey agreed to pay the full amount owed to the courts, £303, in full within 28 days. 

The case was heard at the court on Thursday, (June 8).
