A MAN has been taken to court after piles of flytipped rubbish were dumped in a private road.

Reg Smith of Hipton Hill, Evesham pleaded guilty to duty of care breaches for fly tipping at Worcester Magistrates Court on Thursday, July 7.

The court found in favour of Wychavon District Council and gave Smith a 12 month conditional discharge and ordered him to pay £225 towards Wychavon’s prosecution costs and a victim surcharge of £15.

The dumped waste was cleared by the private landowner.

In court, Smith said that he passed the waste to another man believing that it would be disposed of correctly and apologised for the fact that it had been dumped.

The flytipping (pictured) was discovered on a private road next to Jubilee Bridge, Mill Bank in Fladbury and included builders bags, laminate flooring, wood offcuts and cardboard.

Investigations led to Smith who later pleaded guilty to failing to ensure the rubbish was disposed of correctly.

Sharon Casswell, client services manager at Wychavon said “Flytipping is an eyesore and dangerous to road users and animals if left in the carriageway.

"Wychavon will always pursue a fly tipping case if there are any leads as to who fly tipped the waste whether on public or private land."

In 2015/16 Wychavon spent about £50,000 in enforcement and clean up costs.

She added: “Residents are reminded to check every time they use someone whether a local trader or a large company to do work in or outside your home or solely to remove your domestic waste that they are a registered waste carrier and will take your waste to a licensed disposal facility.

"Do not to be tempted to just use anyone without checking, as if your waste ends up fly tipped and you might get a fine of up to £10,000.

These checks can be carried out on the Environment Agency`s website by searching for public registers or a link can be found on by searching ‘waste carrier licence Wychavon'.

For domestic bulky items you can call FCC Wychavon’s collection contractor who can arrange for a bulky waste collection or you can always take it to the tip for recycling or disposal.

Residents are being reminded that if they see anyone flytipping they can report it to Wychavon for further investigation.
