A MAN has had his case adjourned while it is established whether an alleged victim wished to prosecute.
Marc Gray, aged 38, of Moatway, Malvern, pleaded not guilty to beating Samantha Yapp and not guilty to beating Christopher Johnson on December 14.
He pleaded guilty to using threatening, abusive or insulting words or behaviour to Mr Johnson.
Kerry Lovegrove, prosecuting, said police had charged Gray without taking advice from the Crown Prosecution Services which indicated one of the witnesses did not want to proceed and wanted nothing to do with the case.
Worcester Magistrates Court was told CPS wanted the police officers involved to make enquires about whether this was the case but they were not back on duty until February 4.
Gray was told his case would be adjourned until February 11 for a pre-trial hearing.
Chair Fiona James agreed the hearing could continue in Gray’s absence if he was unable to take time off work as a HGV driver.
He was granted conditional bail not to enter Oak Crescent, Malvern unless directed to by work or to collect his child.
